THIS WEBSITE AND THE INFORMATION AND EVENTS DISPLAYED ON THIS SITE, ALONG WITH MEMBERSHIP IN MBA ROUNDTABLE AND RECEIPT OF THE MEMBERSHIP BENEFITS ARISING FROM MEMBERSHIP (COLLECTIVELY THE "SERVICES") ARE PROVIDED BY MBA ROUNDTABLE, A COLORADO NONPROFIT CORPORATION.  IN PROVIDING THESE SERVICES, MBA ROUNDTABLE MAINTAINS A CONTINUED COMMITMENT TO THE PRIVACY AND SECURITY OF YOUR PERSONAL INFORMATION AND THE INTELLECTUAL PROPERTY RIGHTS OF OTHERS. 
 
SERVICES ARE OFFERED TO YOU CONDITIONED ON YOUR ACCEPTANCE WITHOUT MODIFICATION OF THE FOLLOWING TERMS, CONDITIONS, AND NOTICES CONTAINED IN THIS AGREEMENT (THE "TERMS AND CONDITIONS").  YOUR USE OF THIS WEBSITE, REGISTRATION AS A MEMBER EDUCTIONAL OR ACADEMIC ORGANIZATION, ATTENDANCE AT OR PARTICIPATION IN AN EVENT (INCLUDING SYMPOSIA, WEBINARS, CONFERENCES, ETC.) EITHER AS A PARTICIPANT, SPONSOR OR EXHIBITOR, SUBMISSION OF INFORMATION OR REQUESTS VIA THIS SITE, E-MAIL OR TELEPHONE CONSTITUTES YOUR AGREEMENT TO ALL SUCH TERMS, CONDITIONS, AND NOTICES IN EFFECT AT SUCH TIME, AND TO YOUR CONSENT TO RECEIVE COMMUNICATIONS (INCLUDING MAIL, E-MAIL, TEXT MESSAGES AND TELEPHONE CALLS). 
 
These Terms and Conditions apply to any Services or websites or apps owned and operated by MBA Roundtable including but not limited to this site and mbaroundtable.org.  If you have any questions regarding these Terms and Conditions, you may contact us at the e-mail and telephone numbers listed in the following paragraph.  We may amend these Terms and Conditions at any time by posting a revised version of these Terms and Conditions.  These Terms and Conditions were last updated on May 31, 2018.
 
Information MBA Roundtable Collects and How it is Used
 
I understand that MBA Roundtable collects my personal data to administer MBA Roundtable hosted events and to administer my and/or my organization’s membership or other affiliation with MBA Roundtable.  I can change my personal data, including my contact or background information, in my profile on mbaroundtable.org or by contacting us via e-mail at info@mbaroundtable.org or over the phone at +1 (844) 784-6227 or +1 (610) 616-4593. 2).  Similarly, I can change my organization’s information in the same manner.  I understand that my personal information or organization’s information will be processed and controlled in the United States, which is the primary processing location for MBA Roundtable and its service providers.  In addition, I understand that, based on the location of any events I may attend or the location of my organization, my personal information or the information about my organization may be transferred from the United States to the country of the event or other person or organization, which may not provide for a level of data protection that is equivalent to the one in my home country.
 
I understand that a photograph, video, or audio recording of me (collectively “my content”) may be taken by or on behalf of MBA Roundtable while I am attending, participating or presenting at an event.  By participating in the event in any manner, I am granting MBA Roundtable the right to use, publish, and republish my content without restrictions and without payment by MBA Roundtable for its instructional, informational, promotional, and other business purposes, in any and all media, now known or hereafter created.  My content shall be the sole property of MBA Roundtable.  In addition, I waive the right to inspect or approve versions of my content used for publication.  MBA Roundtable may, but is not required to, include my name in connection with my content.  
 
For member educational or academic organizations of MBA Roundtable, I understand that my name, title, organization, phone, and e-mail address will in MBA Roundtable’s discretion be included on the MBA Roundtable’s website along with similar information on other members. 
 
For event participants, I understand that my name, title, organization, phone, and e-mail address will in MBA Roundtable’s discretion be included on the event attendee list provided to all event participants and exhibitors.  For my own well-being, I may be asked for such event-related information as dietary restrictions, accessibility concerns, and emergency contacts. 
 
If I am a vendor, I understand that my name, social security number or employer ID number, as applicable, and other information from my IRS Form W-9 will be collected.  My name and contact information will be provided to MBA Roundtable event attendees, may be listed on promotional materials, and may be provided to event sponsors, exhibitors and other vendors.
 
I understand that if I participate in Services related to MBA Roundtable events, my information and my content may be provided to third parties such as Facebook, Twitter, or LinkedIn.  As a consequence, I understand that I will be sharing my personal information and my content with these third parties and it will be outside of the control of MBA Roundtable.  IN ADDITION, I UNDERSTAND THAT THE PRIVACY POLICIES AND TERMS AND CONDITIONS OF THIRD-PARTY WEBSITES MAY BE DIFFERENT FROM THE MBA ROUNDTABLE PRIVACY POLICY AND TERMS AND CONDITIONS.  MBA ROUNDTABLE IS NOT RESPONSIBLE FOR THESE PRIVACY POLICIES, TERMS AND CONDITIONS, OR THE CONTENT OF SUCH SITES AND RECOMMENDS THAT I CAREFULLY READ THESE POLICIES.
 
 
 
MBA Roundtable Services; Prohibited Uses
 
The sole purposes for your use of this website is to become a member of MBA Roundtable, to gain information about MBA Roundtable and, if you desire, to contact MBA Roundtable providing your information.  You are not obligated to provide any information.  By submitting information, you consent to being contacted by MBA Roundtable or one of its employees or agents at the contact information you submitted.  If you wish to no longer receive communications from MBA Roundtable, including notifications of upcoming events or events for which you are registered as a participant, sponsor or vendor, you are free at any time to “opt out” by e-mail to info@mbaroundtable.org, and MBA Roundtable will discontinue communications to you within 10 business days.  You may similarly update your contact information by notifying MBA Roundtable via e-mail or telephone.  You acknowledge and agree that your use of this MBA Roundtable website is for your personal use and not for advertising or commercial purposes.  You agree not to copy or collect MBA Roundtable content via robots, spiders, scripts, scrapers, crawlers, or any automated or manual equivalent (e.g., by hand).  You may not use this website for any purpose not contemplated herein.  You acknowledge that a violation of the foregoing could result in significant damages, and you agree that you are liable to MBA Roundtable for any such damages, and will indemnify MBA Roundtable in the event of any claims against MBA Roundtable based on or arising from your violation of the foregoing.  MBA Roundtable reserve the right to revoke your access to any MBA Roundtable Services at any time.  If it is determined or suspected by MBA Roundtable in its sole discretion that you are misusing or attempting to misuse or circumvent the MBA Roundtable Services or systems, or are using or attempting to use them for any inappropriate or non-personal purposes, including but not limited to activities such as hacking, scraping content, infiltrating, fraud, advertising, jamming or spamming, MBA Roundtable reserves the right, in its sole discretion, to immediately terminate your access without notice and to initiate without notice appropriate legal actions or proceedings to seek appropriate remedies and/or damages, including but not limited to lost revenue, repairs, legal fees, costs and expenses, and to seek injunctions or other equitable remedies.
 
Third Party Copyrights And Other Rights
 
MBA Roundtable respects the intellectual property rights of others.  If you believe that your copyright or trademark has been infringed, please send us a notice as set forth below, the content of which is incorporated into these Terms and Conditions.  For any intellectual property claims, please send us a notice at info@mbaroundtable.org.  If you believe that your copyright is being infringed, you can file a DMCA notification by a notice at info@mbaroundtable.org.  Your claim must include the following information (please note that all information must be submitted in English):

  • an electronic or physical signature of the person authorized to act on behalf of the owner of the trademark or copyright interest;
  • a description of the copyrighted or trademarked work that you claim has been infringed;
  • a description of where the material that you claim is infringing is located on the Site, sufficient for MBA Roundtable to locate the material;
  • your address, telephone number, and email address;
  • a statement by you that you understand that under 17 U.S.C § 512(f) you may be liable for any damages, including costs and attorneys' fees, if you knowingly and materially misrepresent that reported material or activity is infringing;
  • a statement by you that you have a good faith belief that the disputed use is not authorized by the copyright or trademark owner, its agent, or the law; and

WARRANTIES: LIMITATIONS OF LIABILITY; LIMITATIONS OF DAMAGES
 
YOU ACKNOWLEDGE AND AGREE THAT THE MBA ROUNDTABLE SERVICES ARE PROVIDED TO YOU ON AN "AS IS" BASIS WITHOUT ANY WARRANTY WHATSOEVER, AND YOUR SOLE AND EXCLUSIVE REMEDY, AND MBA ROUNDTABLE’ SOLE OBLIGATION TO YOU OR ANY THIRD PARTY FOR ANY CLAIM ARISING OUT OF YOUR USE OF THE MBA ROUNDTABLE SERVICES OR THE MBA ROUNDTABLE OR APPS, IS THAT YOU ARE FREE TO DISCONTINUE YOUR USE OF THE MBA ROUNDTABLE SERVICES OR THE MBA ROUNDTABLE WEBSITES OR APPS AT ANY TIME.  EXCEPT AS EXPRESSLY SET FORTH HEREIN, MBA ROUNDTABLE EXPRESSLY DISCLAIMS ANY IMPLIED WARRANTIES OF ANY KIND, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, AND YOU AGREE THAT MBA ROUNDTABLE SHALL HAVE NO LIABILITY FOR DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL (INCLUDING LOST PROFIT), EXEMPLARY OR PUNITIVE DAMAGES (EVEN IF MBA ROUNDTABLE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES) ARISING OUT OF THIS AGREEMENT OR ANY CONSEQUENCES WHICH FLOW FROM IT.  IN NO EVENT SHALL MBA ROUNDTABLE, INC. BE LIABLE TO YOU FOR ANY AMOUNT IN EXCESS OF ALL AMOUNTS PAID BY YOU TO MBA ROUNDTABLE, INC. WITHIN ONE YEAR AFTER YOUR USE OF THIS WEBSITE.
 
CERTAIN STATE LAWS DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES OR THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES.  IF THESE LAWS APPLY TO YOU, SOME OR ALL OF THE ABOVE DISCLAIMERS, EXCLUSIONS, OR LIMITATIONS MAY NOT APPLY TO YOU, AND YOU MIGHT HAVE ADDITIONAL RIGHTS.
 
INDEMNIFICATION
 
YOU AGREE TO INDEMNIFY MBA ROUNDTABLE, ANY HOST, PRESENTER OR SPONSOR OF ANY EVENT, AND ITS AND THEIR SUBSIDIARIES, AFFILIATES, OFFICERS, EMPLOYEES, TRUSTEES, STAFF, AGENTS, CO-BRANDERS, AND ANY PARTNERS AND HOLD THEM EACH HARMLESS FROM ANY AND ALL CLAIMS OR DEMANDS, INCLUDING ATTORNEY'S FEES, MADE BY ANY THIRD PARTY DUE TO OR ARISING FROM YOUR USE OF THE MBA ROUNDTABLE SERVICES AND YOUR USE OF THE MBA ROUNDTABLE WEBSITE, YOUR VIOLATION OF THESE TERMS AND CONDITIONS, OR ARISING FROM YOUR VIOLATION OF ANY RIGHTS OF A THIRD PARTY.
 
AGREEMENT TO ARBITRATE ALL DISPUTES AND GOVERNING LAW
 
These Terms and Conditions, and any dispute between you and MBA Roundtable, shall be governed by the laws of the State of Colorado without regard to principles of conflicts of law, provided that this arbitration agreement shall be governed by the Federal Arbitration Act.
THE EXCLUSIVE MEANS OF RESOLVING ANY DISPUTE BETWEEN YOU AND MBA ROUNDTABLE or any claim or controversy arising out of or relating to use of this Website and/or MBA Roundtable’ services (including any alleged breach of these Terms and Conditions) SHALL BE BINDING ARBITRATION administered by the American Arbitration Association or as otherwise agreed by MBA Roundtable, EXCEPT AS EXPRESSLY PROVIDED BY APPLICABLE FEDERAL OR STATE LAW AND PROVIDED THAT MBA ROUNDTABLE SHALL HAVE THE RIGHT TO SEEK INJUNCTIONS IN ANY APPLICABLE COURT OF LAW.  You may not under any circumstances commence, participate in or maintain against MBA Roundtable any class action, class arbitration, or other representative action or proceeding.
 
General Provisions
 
The Terms and Conditions will inure to the benefit of MBA Roundtable’ successors, assigns and licensees.  If any provision of these Terms and Conditions shall be deemed unlawful, void or unenforceable for any reason by any court of competent jurisdiction, that provision shall be modified in order to make it enforceable, while maintaining the spirit of the provision. Alternatively, if modification is not possible, such provision shall be stricken and shall not affect the validity and enforceability of the remaining terms.  The failure of MBA Roundtable to exercise or enforce any right or provision of the Terms and Conditions shall not constitute a waiver of such right or provision.  You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of the Services or the Terms and Conditions must be filed within one (1) year after such claim or cause of action arose or be forever barred. The section titles in the Terms and Conditions are for convenience only and have no legal or contractual effect.  These Terms and Conditions are governed by the laws of the State of Colorado as such laws are applied to agreements entered into and to be performed entirely in the State of Colorado and between Colorado residents.  You agree to submit to jurisdiction in Colorado and that any claim arising out of or related to these Terms and Conditions will be brought solely in Arapahoe County, Colorado. These Terms and Conditions constitute the entire agreement between you and MBA Roundtable and supersede all oral and written negotiations or representations of the parties with respect to the subject matter hereof.

This privacy statement discloses the privacy practices for MBA Roundtable, Inc.
 
            Information Collection and Use.  MBA Roundtable is the sole owner of the information collected on this site.  MBA Roundtable will not sell, share, or rent this information to others in ways different from what is disclosed in this statement.  MBA Roundtable may collect information from users at several different points on this or other websites or at events sponsored by MBA Roundtable for which you enroll or at which you may attend.
 
            Cookies.  A cookie is a piece of data stored on the user’s hard drive containing information about the user.  Usage of a cookie is in no way linked to any personally identifiable information while on our site.  Once the user closes his or her browser, the cookie simply terminates.  For instance, by setting a cookie on our site, the user may not have to log in a password more than once, thereby saving time while on our site.  If a user rejects the cookie, the user may still use our site, although the user may be limited in some areas of our site.  Cookies can also enable us to track and target the interests and attributes of our users to enhance the experience on our site.  Some of our business partners (for example, advertisers) may use cookies on our site.  However, we have no access to or control over these cookies.
 
            Log Files.  MBA Roundtable uses IP addresses to analyze trends, administer the site, track user’s movement and gather broad demographic information for aggregate use.  IP addresses are not linked to personally identifiable information.
 
            Links.  This website contains links to other sites.  Please be aware that MBA Roundtable is not responsible for the privacy practices of such other sites not owned by MBA Roundtable.  MBA Roundtable encourages users to be aware when users leave our site and to read the privacy statements of each and every website that collects personally identifiable information.  This privacy statement applies solely to information collected by this or other MBA Roundtable websites.
 
            Security.  This website takes reasonable and customary precautions to protect users’ information.  When users submit sensitive information via the website, that information is protected both online and off-line.  That information is encrypted and is protected with the SSL encryption software.  While we use SSL encryption to protect sensitive information online, MBA Roundtable uses the data storage and retrieval services of third parties. MBA Roundtable cannot make representations or assurances about the privacy and data security practices of third parties.  Only employees of MBA Roundtable who need the information to perform a specific job are granted access to personally identifiable information.  MBA Roundtable employees are kept up-to-date on our security and privacy practices.  MBA Roundtable cannot make representations or assurances about the privacy and data security practices of others.  If users have any questions about the security at those organizations, users should contact those organizations directly.
 
            Site and Service Updates.  MBA Roundtable may also send site and service announcement updates to users.  Users may not be able to un-subscribe from service announcements, which contain important information about the service.  MBA Roundtable communicates with users to provide requested services and in regard to issues relating to their accounts via email or phone.
 
            Disclosure for Law Enforcement.  Notwithstanding the other statements in this policy, MBA Roundtable reserves the right to provide user information to third parties when required to comply with U.S. or foreign law or legal procedure, to protect MBA Roundtable’ rights and property, and in emergency situations if physical safety or health is at issue.
